Reel Reflection Studios - Videography Agreement

ENTIRE AGREEMENT: This agreement contains the entire understanding between Videographer/DJ and the client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the

parties.


RESERVATION: A signed contract and retainer (30% deposit of all desired services) are required to reserve the specified coverage. The final payment of the balance owing is due by the date of the event. If the remaining balance is not paid by the scheduled date of the event, we reserve the right not to record the event. Please make all cheques payable to “Reel Reflection Studios”. A $50 NSF fee will be charged for returned cheques.


CANCELLATION: If the client shall cancel this agreement, any deposit paid to Reel Reflection Studios or Kaila Christianson shall not be refunded. You may not transfer the deposit to another party, bridal couple, or anyone else without prior written consent.


HOUSE RULES: The Videographer is limited by the guidelines of the event site management. Client agrees to accept the technical results of their imposition on the Videographer. Negotiation with the officials for moderation of guidelines is client's responsibility; the Videographer will offer technical recommendations only.


FILM AND COPYRIGHTS: The videos produced by the Videographer are protected by Federal Copyright Law (all rights reserved) and may not be

reproduced in any manner without the Videographer's explicitly written permission. Upon final payment by the client, limited copyright ownership of the resulting images will be transferred to the client under the following conditions:

(1) The digital copies of the videos are the property of the client for personal use and for the purposes of the reproduction and giving of videos to friends and relatives.

(2) The client must obtain written permission from and compensate the Videographer prior to the client or its friends and relatives publishing or selling the videos for profit.


EXHIBITION: Client grants the Videographer permission to display selected images or clips as an example of the Videographer's work and for entrance into competitions and release all claims to profits that may arise from use of videos.


MODEL RELEASE: The client hereby grants to the Videographer and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish videos of the client or in which the client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The client hereby releases the Videographer and its legal representatives and assigns from all claims and liability relating to

said videos.


LIMIT OF LIABILITY: In the unlikely event that the Videographer is injured or becomes too ill to cover the event, the Videographer will make every effort to secure a replacement Videographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package.


The Videographer takes the utmost care with respect to exposure, transportation, and processing the videos. However, in the unlikely event that videos have been lost, stolen, or destroyed for reasons within or beyond the Videographer's control, the Videographer's liability is limited to the return of all payments received for the event. The limit of liability for a partial loss of originals shall be a prorated amount of the footage lost based on the percentage of total footage.


MEALS: If the Videographer is shooting at the time of dinner, a meal shall be provided for Reel Reflection Studios and the assistant at the event. In the event a meal is not provided, client will need to allow for 45 minutes for Videographer and Assistant to leave the event and find a meal.


OVERTIME: On the noted wedding date, if the number of hours exceed what was agreed upon, overtime will be billed, and is to be paid at the overtime rate of $50 per hour.
